I just recently recieved my 1st exam for TDRL. I got back a 40% and placed on PDRL informal decision. I was wondering if anybody had a opinion on this. They did not rate me under the 5002-5009 just the 5240 code. I might submit a request to review my disablity under the 5002 code. Or should I accept the decision and try to fight the VA for a higher rating? Mike or anybody willing to help?

John,

It may be very difficult to get a higher rating under DC 5002. You might not want to risk the formal board rating you below 30%. Have you been rated by the VA yet? If so, what rating did they give you and did they consider the 5002 criteria?

Hello Mike,
I actually posted on here a long time ago. I did get my rating back from the VA but it was for the 5240 only. They did not consider my rating under the 5002 criteria. I recieved 20% for my lower back and 20% for my cervical spine. Then I got 10% for rosatia of the face. My total combined rating is 40% which I don't know how they figured that out.
The Navy is giving me 40% under the thoracic spine because my range of motion is less then 30 degrees for all measurments. I think my rating should be higher for the VA but I just don't know where to begin or what to do
